Personal Data may be freely provided by the User, or, in case of Usage Data, collected automatically when using this website.

In addition to the Owner, in some cases, the Data may be accessible to certain types of persons in charge, involved with the operation of this website (administration, sales, marketing, legal, system administration) or external parties (such as third-party technical service providers, mail carriers, hosting providers, IT companies, communications agencies) appointed, if necessary, as Data Processors by the Owner. The updated list of these parties may be requested from the Owner at any time.

The Data is processed at the Owner’s operating offices and in any other places where the parties involved in the processing are located.

Retention time

Unless specified otherwise in this document, Personal Data shall be processed and stored for as long as required by the purpose they have been collected for and may be retained for longer due to applicable legal obligation or based on the Users’ consent.

The purposes of processing

The Data concerning the User is collected to allow the Owner to provide its Service, comply with its legal obligations, respond to enforcement requests, protect its rights and interests (or those of its Users or third parties), detect any malicious or fraudulent activity, as well as the following: Contacting the User, Sending catalogues and commercial updates, Email management, Hosting and website security.

Detailed information on the processing of Personal Data

Personal Data is collected for the following purposes and using the following services:

Contacting the User — Enquiry forms (this website)

By filling in one of the enquiry forms on this website (quotation request, request to become a distributor) with their Data, the User allows these details to be used to reply to requests for information, quotes or any other kind of request as indicated by the form’s header.

The Data entered in the form is transmitted to this website’s server and recorded in a restricted archive of the Owner, which only authorised staff can consult, with personal credentials. When a request is sent, the person in charge of the website receives an email notice showing the User’s name, company and country.

To prepare the reply, the text of the request may be read by an automated language processing program that the Owner runs on its own computers, without using third-party services. For internal use, the program suggests a summary and a classification of the request (language, type of request, models of interest, urgency). No decision concerning the User is taken automatically: every request is read and handled by a person.

Requests that the Owner follows up are recorded in its database of business contacts (CRM).

If sending to the website fails, the form composes an email in the User’s own mail program, addressed to the Owner’s mailbox webmaster@celaplatforms.com: in that case the Data travels only with that message.

Personal Data processed: first and last name; email address; phone number; company name; country; model, chassis, quantity and options of interest; company profile or activity; requested territory and brands handled (request to become a distributor); message; various types of Data.

The fields marked as required in the form are mandatory (name and email; in the distributor form also company name and territory): without them no reply is possible. All other Data is optional and only helps to prepare a more accurate reply.

Legal basis: steps taken at the User’s request prior to entering into a contract (Article 6(1)(b) GDPR).

Retention: enquiries that do not lead to a contract are kept for 24 months from the last contact and then deleted; Data connected with a contract is kept for the periods required by law.

Sending catalogues and commercial updates (this website)

The forms include an optional box, “Commercial updates”, never pre-ticked, with which the User can ask to receive catalogues and news about the Essential range by email. Ticking it is a separate consent under Article 6(1)(a) GDPR and Article 130 of the Italian Privacy Code (Legislative Decree 196/2003); leaving it empty has no effect whatsoever on the reply to the request.

Consent can be withdrawn at any time, without affecting the lawfulness of processing carried out before the withdrawal, by writing to the Owner (info@cela.it) or to the DPO (privacy@cela.it).

Retention: until consent is withdrawn.

Email management — Google Workspace (Google Ireland Limited)

Notices of requests received through the forms, messages composed by the forms when sending to the website fails, and any other email sent to the Owner are received through CELA’s business email, run on Google Workspace, a service provided by Google Ireland Limited, which acts as a Data Processor.

Personal Data processed: the Data contained in the messages.

Place of processing: Ireland. Messages may also be processed outside the European Union, on the basis of the EU-US Data Privacy Framework and the standard contractual clauses.

Hosting and website security — Vulcania System S.r.l.

This website is hosted by Vulcania System S.r.l. (Via Ugo Zannoni 8, 37136 Verona, Italy, VAT no. 03091060230), which acts as a Data Processor under Article 28 GDPR. The servers are located in a data centre of Hetzner Online GmbH in Germany, a sub-processor of the provider: navigation Data stays within the European Union and is not transferred to third countries. The archive of requests sent with this website’s forms is also kept on the same servers.

Like any web server, this one records the requests it receives (access logs) for security purposes and to keep the website working properly, and deletes these logs after 30 days. From the same logs, aggregate traffic statistics are produced, which contain no IP addresses and which only those who manage the website can see: they use no Cookies or other tools on the User’s device.

Personal Data processed: Usage Data (IP address, user agent, page requested, referring page, date and time).

Legal basis: the Owner’s legitimate interest in keeping the service secure (Article 6(1)(f) GDPR).

Place of processing: Germany.

Cookie Policy

This website sets no Cookies and uses no other Trackers, whether its own or third-party. To learn more, Users may consult the Cookie Policy.

The only exception is the area reserved for CELA staff, which uses a technical Cookie to keep them signed in.

Legal basis of processing

The Owner may process Personal Data relating to Users if one of the following applies:

  • provision of Data is necessary for the performance of an agreement with the User and/or for any pre-contractual obligations thereof;
  • processing is necessary for compliance with a legal obligation to which the Owner is subject;

  • processing is necessary for the purposes of the legitimate interests pursued by the Owner or by a third party.

In any case, the Owner will gladly help to clarify the specific legal basis that applies to the processing, and in particular whether the provision of Personal Data is a statutory or contractual requirement, or a requirement necessary to enter into a contract.

Further information about retention time

Unless specified otherwise in this document, Personal Data shall be processed and stored for as long as required by the purpose they have been collected for and may be retained for longer due to applicable legal obligation or based on the Users’ consent.

Therefore:

  • Personal Data collected for purposes related to the performance of a contract between the Owner and the User shall be retained until such contract has been fully performed.
  • Personal Data collected for the purposes of the Owner’s legitimate interests shall be retained as long as needed to fulfil such purposes. Users may find specific information regarding the legitimate interests pursued by the Owner within the relevant sections of this document or by contacting the Owner.

The Owner may be allowed to retain Personal Data for a longer period whenever the User has given consent to such processing, as long as such consent is not withdrawn. Furthermore, the Owner may be obliged to retain Personal Data for a longer period whenever required to fulfil a legal obligation or upon order of an authority.

Once the retention period expires, Personal Data shall be deleted. Therefore, the right of access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after expiration of the retention period.

The rights of Users based on the General Data Protection Regulation (GDPR)

  • Lodge a complaint. Users have the right to bring a claim before their competent data protection authority.

Users have the right to lodge a complaint under Articles 77 et seq. of the GDPR with a supervisory authority, which in Italy is the Garante per la Protezione dei Dati Personali (www.garanteprivacy.it). The procedures, methods, and timeframes for lodging complaints are governed by national legislation. Filing a complaint does not affect any other administrative or judicial remedies, which in Italy may be pursued before either the Garante or the competent court.

How to exercise these rights

Such requests are free of charge and will be answered by the Owner as early as possible and always within one month, providing Users with the information required by law. Any rectification or erasure of Personal Data or restriction of processing will be communicated by the Owner to each recipient, if any, to whom the Personal Data has been disclosed unless this proves impossible or involves disproportionate effort. At the Users’ request, the Owner will inform them about those recipients.
